(5-1) The Service of Registering/Discharging a Mortgage of a National Ship

MAA offers the service of registration or discharge a mortgages on the ships registered under the Yemeni registry. This service is provided, in accordance with the relevant law, bylaws, directives and regulations in force, at MAA Sana’a headquarters, subject to the following conditions and procedures:

First: Registering a National Ship Mortgage

A)Conditions:

  1. A mortgaged ship shall not be less than 20 tons GRT.
  2. The mortgagor shall be the ship owner registered at MAA records.
  3. The mortgagee shall be either a physical or moral person, including national, banks and financial institutions,
  1. B) Procedures:
  2. Filling the relevant MAA application form to be signed and submitted by the owner.
  3. The application should be submitted along with the following documents:
  • two original copies of the mortgage contract approved as per law
  • two Signed lists by the applicant that include:
  1. first name and last name, nationality, domicile and rofession of the mortgagee and mortgagor.
  2. Date and type of the mortgage contract.
  3. Debt value indicated in contract. If the mortgage is on more than one ship, the debt of each one shall be specified. If the mortgage is on a ship and another property, the two list should indicate the ship’s mortgage debt.
  4. Conditions of costs of the debt if exists and payment provisions.
  5. Name and particulars of the mortgaged ship, date and number of its registration certificate or its building statement from the builder and its code number at the builder’s site.
  6. The place of the mortgagee.
  • Original registration certificate of the ship.
  1. The above documents are then checked by MAA personnel for the validity and accuracy of the details contained therein based on the MAA ship register.
  2. Upon completion of the above procedures and payment of relevant fees, the mortgage is registered at the ship register and at the back of the original registration certificate of the ship.

The registration certificate is to be given back to the owner along with an original copy of the mortgage contract stamped with the mortgage registration number.

Second :Discharge of a Ship Mortgage        

  1. A) : Conditions:
    1. A ship mortgage shall be already registered at MAA registry as per the above procedures.
    2. The ship mortgage should have been released.
    3. The discharge shall be at the consent of the mortgagee.
  1. B) : Procedures
    1. An application for the discharge of the ship’s mortgage is to be submitted by the owner along with a accredited signed statement by the mortgagee for the discharge the ship’s mortgage.
    2. The application should be submitted with the original registration certificate of the mortgaged ship.
    3. The above documents are then checked by MAA personnel on the accuracy of the details contained therein based on the MAA ship register.
    4. Upon completion of the above procedures and payment of relevant fees, the mortgage is discharged and deleted from records. Such deletion is carried out also on the relevant documents including the ship register, the registration certificate, and the mortgage contract. The ship registration certificate is given back to the ship’s owner.

Fourth: Time set for Registering and Discharging a Ships Mortgage

This service is to be accomplished within 24 hours after the completion of the relevant procedures.
